1. About NESTres

The NESTres platform is operated by Nest Group Australia Pty Ltd (ACN 683 193 188) ("we", "us", "our"). NESTres is a "household-first" digital platform providing intelligent property lifecycle logbook services for households, tradies, builders, suppliers, inspectors, and other property stakeholders in Australia.

2. Intellectual Property

All content, features, functionality, design, code, trademarks, logos, and intellectual property on the NESTres platform — including but not limited to the NESTres name, the "Nr" logo, the app names (nesthome, nestbuild, nestcheck, nestspace), the platform architecture, the property lifecycle logbook concept, and all associated materials — are the exclusive property of Nest Group Australia Pty Ltd (ACN 683 193 188) and are protected under Australian and international intellectual property laws.

Unauthorised copying, reproduction, distribution, modification, scraping, data extraction, reverse engineering, or any other use of NESTres content or technology — whether for commercial, AI training, or any other purpose — is strictly prohibited without prior written consent from Nest Group Australia Pty Ltd.

3. Accounts and Eligibility

You must be at least 18 years of age to create an account and use the NESTres platform. By creating an account, you represent and warrant that you are 18 or older and that all information you provide is accurate and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at [email protected] if you suspect any unauthorised access to your account.

4. Subscriptions and Payments

Access to paid features of the NESTres platform requires a valid subscription. All subscription plans are billed in Australian dollars (AUD) and include GST where applicable. Payment is required at the time of sign-up.

All paid plans include a 30-day free trial period. You may cancel your subscription at any time. If you cancel, you will retain access to the platform until the end of your current billing period. No refunds are provided for unused portions of a billing period.

We reserve the right to change subscription pricing with 30 days' notice. Continued use of the platform after a price change constitutes your acceptance of the new pricing.

5. Acceptable Use

You agree to use the NESTres platform only for lawful purposes and in accordance with these Terms. You must not:

• Upload false, misleading, or fraudulent documents or information.
• Use the platform to harass, defame, or harm other users.
• Attempt to gain unauthorised access to any part of the platform or another user's account.
• Use automated tools, bots, scrapers, or crawlers to extract data from the platform.
• Use platform content or data to train AI or machine learning models without prior written consent.
• Violate any applicable Australian law or regulation.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

6. User Content

You retain ownership of all documents, records, photos, and other content you upload to the NESTres platform ("User Content"). By uploading User Content, you grant Nest Group Australia Pty Ltd a limited, non-exclusive licence to store, process, and display your User Content solely for the purpose of providing the platform services to you.

You are solely responsible for the accuracy, legality, and appropriateness of your User Content. We reserve the right to remove any User Content that violates these Terms or applicable law.

7. Shared Access and Permissions

The NESTres platform allows you to grant other users (such as tradies, inspectors, or co-owners) access to specific records in your account. You are responsible for managing and reviewing these permissions. We are not liable for any consequences arising from access you have granted to other users.

8. Disclaimer of Warranties

The NESTres platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components. To the maximum extent permitted by Australian law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by the Australian Consumer Law and other applicable legislation, Nest Group Australia Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the NESTres platform. Our total liability to you for any claim arising from these Terms or your use of the platform shall not exceed the total amount you have paid to us in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time if you breach these Terms or engage in conduct that we reasonably believe is harmful to other users, third parties, or the platform. You may terminate your account at any time by contacting us at [email protected].

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of New South Wales.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or by displaying a notice within the platform. Your continued use of the platform after changes take effect constitutes your acceptance of the updated Terms.
